Who chooses the closing agent for a Florida real estate transaction depends on what county the property is located. The general rule is that the one paying for title insurance is who chooses the closing agent. In most counties in Florida, that is the seller. Below identifies who chooses in which counties:

Buyer chooses the closing agent – The counties where the buyer chooses the closing agent include Broward, Miami-Dade, Sarasota, and Collier County.


Seller chooses the closing agent – The counties where the seller chooses the closing agent include all counties in Florida except for Broward, Miami-Dade, Sarasota, and Collier County.

While above is the general default rule for who chooses the closing agent, the buyer and seller can agree to allow one or the other party to choose the closing agent regardless of the county where the property is located.
