What is the standard Florida real estate contract used where you live?

There are standard residential real estate contracts used throughout the state of Florida. Which contract you use will largely depend on the county where the property is located. The standard contract forms used throughout the state along with the counties where they are used are as follows:

Standard Residential Contract For Sale And Purchase and the “AS IS” variation (the “FARBAR Conracts”) – Miami-Dade, Monroe, Broward, Palm Beach, Hendry, Glades, Martin, Saint Lucie, Okeechobee, Highlands, De Soto, Hardee, Sarasota, Manatee, Hillsborough, Polk, Osceola, Indian River, Brevard, Orange, Seminole, Lake, Sumter, Pasco, Pinellas, Hernando, Citrus, Marion, Volusia, Flagler, Alachua, Levy, Gilchrist, Dixie, Lafayette, Taylor, Madison, Suwannee, Hamilton, Columbia, Baker, Union, Bradford, Franklin, Gulf, Liberty, Calhoun, Bay, Washington, Holmes, and Jackson County.

Florida Realtors Contract for Residential Sale and Purchase (CRSP) – Okaloosa and Walton County.

Naples Area Board of Realtors Contract (NABOR) – Charlotte, Lee, and Collier County.

Northeast Florida Association of Realtors Contract (NEFAR) – Putnam, Saint Johns, Clay, Duval, and Nassau County.

Tallahassee Board of Realtors Contract (TBR) – Gadsden, Leon, Wakulla, and Jefferson County.

As you can see, the FARBAR Contracts are the most common contracts used throughout the state of Florida. The FARBAR “AS IS” variation is more common than the standard form.

It should be noted that just because your county commonly uses one contract, that does not mean that you must use that contract. You can use any of the Florida contracts throughout the state. However, real estate practitioners will likely be more familiar with the real estate contract commonly used in their county, so it may be a good idea to use the contract that is commonly used in your county. The only exception might be the FARBAR Contracts because they are used so often throughout the entire state of Florida.
